How the tipped wage works
Employers can count part of a tipped worker’s tips toward the minimum wage. This is the tip credit . Florida’s Constitution ties it to the federal tip credit as of 2003, which is $3.02 [1][3]. So:
- The employer must pay at least $11.98 an hour in cash.
- Cash wages plus tips must reach at least $15.00 for every hour worked.
- If tips fall short in a pay period, the employer has to make up the difference.
The tip credit only applies to workers who meet the federal rules for tipped employees, which generally means regularly receiving more than $30 a month in tips [3].
After $15: inflation adjustments
From 2027 on, the raises are no longer a flat $1.00. Each September 30, starting in 2027, the state calculates a new rate by adjusting for inflation over the prior twelve months. That rate is published and takes effect the following January 1 [1][2]. In practice, the next change after $15.00 should arrive on January 1, 2028. The state must post the new amount by October 15 each year [2].
If you’re paid less than the minimum
Florida law gives workers a way to recover unpaid minimum wages. Before filing a lawsuit under the state statute, you must notify your employer in writing, and the employer has 15 calendar days to pay or resolve the claim. The deadline to sue is paused during those 15 days [2].
Federal law also protects most workers, and the U.S. Department of Labor’s Wage and Hour Division takes complaints for free.
